Terms and Conditions.
These Terms and Conditions (“Terms”) govern your access to and use of dotik, our website, and digital QR menu platform (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Who we are
dotik is operated as an independent project by its creator, available at dotik.eu and dotik.sk. During this demo phase there is no registered company behind the Service. For questions, contact dotik.contactus@gmail.com.
2. The Service
dotik lets businesses create, manage, and publish digital menus accessible via QR codes and shareable links. Features may include themes, menu items, team invitations, and related tools. We may add, change, or remove features over time.
3. Eligibility
You must be at least 16 years old (or the minimum age in your jurisdiction) and able to form a binding contract. If you use the Service on behalf of a business, you confirm you have authority to bind that business to these Terms.
4. Accounts and authentication
- You must provide accurate registration information and keep it up to date.
- You may register with email and password or, where available, sign in with Google. If you use Google, you are also subject to Google’s terms and privacy policy for that sign-in.
- You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- Notify us promptly at dotik.contactus@gmail.com if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms or pose a security risk.
5. Your content
You retain ownership of menu text, images, logos, and other materials you upload (“Your Content”). You grant us a non-exclusive, worldwide licence to host, store, reproduce, display, and distribute Your Content solely to operate and improve the Service (e.g. showing your menu to guests who scan your QR code).
You represent that:
- You have the rights to upload and publish Your Content
- Your Content does not infringe third-party rights or applicable law
- Menu information (prices, allergens, descriptions) is accurate to the best of your knowledge
6. Acceptable use
You agree not to:
- Use the Service for unlawful, misleading, or harmful purposes
- Upload malware, spam, or content that is defamatory, obscene, or discriminatory
- Attempt to bypass security, scrape the Service excessively, or disrupt infrastructure
- Impersonate others or misrepresent your affiliation with a business
- Use the Service to collect personal data from guests without a lawful basis
7. Teams and invitations
Account owners may invite others to manage an establishment. Owners are responsible for permissions they grant. Invited users must comply with these Terms. We are not responsible for disputes between team members or establishments.
8. Plans and fees
During this demo phase, dotik is provided free of charge. You will not be billed for using the Service at this time.
We plan to introduce paid plans in the future. Before any charges apply, we will update these Terms, publish clear pricing, and give existing users reasonable notice. You will not be charged unless you explicitly choose a paid plan after that notice.
9. Our intellectual property
dotik, its software, design, branding, and documentation are owned by us or our licensors. These Terms do not grant you any rights to our trademarks or code except as needed to use the Service.
10. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. Maintenance, updates, or events outside our control may cause downtime. We may modify or discontinue the Service or any feature with reasonable notice where practicable.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or if continued provision becomes impractical. Upon termination, your right to use the Service ends; sections that by nature should survive (e.g. liability limits, governing law) will continue to apply.
12. Disclaimers
The Service is provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant that the Service will be error-free, that menus will always display correctly on every device, or that the Service meets your specific business requirements. You are responsible for compliance with food-labelling, allergen, and consumer-protection rules applicable to your business.
13. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for claims relating to the Service is limited to the amount you paid us in the twelve (12) months before the claim, or EUR 100 if you use a free plan.
Nothing in these Terms limits liability that cannot be limited under mandatory law (including death or personal injury caused by negligence, or fraud).
14. Indemnity
You will indemnify and hold us harmless from claims, damages, and costs arising from Your Content, your use of the Service, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.
15. Governing law and disputes
These Terms are governed by the laws of Slovakia, without regard to conflict-of-law rules. Courts in Slovakia have exclusive jurisdiction, unless mandatory consumer protection rules in your country require otherwise.
EU consumers may also use the European Online Dispute Resolution platform.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. If changes are material, we may notify you by email or in the Service. Continued use after changes take effect constitutes acceptance, unless applicable law requires otherwise.
